Dear colleagues,

As discussed at the June meeting and reported in the meeting minutes, the draft EBP Data Sharing Policy<https://docs.google.com/document/d/1zPx_-JTxg_mOwxBuTviuL6I-RrHLoFTH/edit#heading=h.gjdgxs> is ready for a vote of this committee.

A vote of YES supports the current draft<https://docs.google.com/document/d/1zPx_-JTxg_mOwxBuTviuL6I-RrHLoFTH/edit#heading=h.gjdgxs> being sent to the Executive Council for review, with the suggestion that it should also go to a number of EBP projects for review, feedback, and potential alignment/harmonization with existing policies.

As the convener of the policy, I note that the text about blurring of location currently says:

Blurring of the location beyond 1km is permitted when needed to protect the conservation status of sensitive species or populations, or if requested by an Indigenous people or local community in order to protect their cultural heritage when sampling in proximity to a site of cultural significance.

The meeting ended at about 9:50am EDT yesterday morning, so we must have just missed you! We finalized and sent forward the data sharing draft, but I expect that we will receive comments back from the EC and so will have it back on our agenda next month.

One reason for the 1-year embargo was advice from the lawyers that in order
to be exempt from export sanctions, 1 year was probably the maximum.

I am sorry I have been pre-occupied by other things. My position I don’t think is so far from, or incompatible with, Uljana’s.

I am very happy for any nation to make a list of species, or classes of species (such as all plants, or all vertebrates, or all species) for which they do not wish EBP members to generate and deposit reference genomes in INSDC, where these are generated from samples derived from their territory. That is their sovereign right under CBD. Currently New Zealand says no to all species, which is totally OK and we all

1. I prefer Uljana’s language: “This implies that this reference sequence information be free of any legal encumbrances, including patents or restrictive use licenses”. My concern with any language that includes “mandate” is that it reads punitively, and we do not really have authority or capacity to uphold it.

The only significant changes since the last circulated version are (1) that following Krystal’s comments I have added an explicit reference to LocalContexts, and (2) that I added paragraph 4 about there being a one-year limit on embargos, modelling the language on that in the Governance document.

Manuela’s comment on clause 3 reflects exactly the concern that I had been trying to express. I fully support the first sentence
It is the intent of the EBP that submitted sequences have no restrictions on download and as few restrictions on use as [are] consistent with local law and equity.

This is basically an argument for augmenting current data structures and
not building a new database.

Makes sense.

But a few observations about the text, which are probably too difficult to
accommodate, but perhaps worth observing.

It is quite common for such statements to begin with a description of the
organization and the members it represents. But it's irrelevant to the
substance and could be handled by a footnote. It delays getting to the
point to paragraph 3.

Hi Debra and All!

Unfortunately I can't attend the meeting today because I have another meeting.
I would just like to report that I participated in COP 16.2 (February 25-27), which was the resume of COP 16 that was not finalized in Cali.
This meeting took place in Rome, in UN Food and Agriculture Organization Headquarters (FAO), and all the decisions, which were mainly related to financing and monitoring, were approved. The decision on DSI (16/2) that was adopted by CBD COP16 was also approved by COP-MOP Nagoya Protocol.

The view of the folks on the call today was that we (after much deliberation over almost three years and with periodic input from the Executive Committee) are comfortable with this document as is. "Practical Guide to Accessing and Sharing Biological Diversity Material and
Data: A Research Stage-Based Approach." Rob Waterhouse (of our Governance
Comm) gave me the heads-up and says it appears to be more of a checklist
than a guide. I haven't had the chance to review it yet.

I’m writing to follow up on my meeting with the Executive Committee in January regarding the EBP IP Policy drafted by the ELSI Committee. The ELSI Committee met last week and discussed the feedback from the EC and are submitting now our proposed IP Policy (attached). We have made a change to the opening paragraph that we think addresses Mark Blaxter’s concern, but would like his feedback on this point.

I agree that it is important to require that any legal restrictions on use that do arise from legislation or quite should be explicitly stated.

I think we should make it clearer that “local law” refers to the law of the country/location from which the sample giving rise to the sequence was taken, rather than the location of the sequencer/submitter.

After today's meeting, I remembered about this program. Many Indigenous
scientists wear several hats in addition to those
ascribed by the scientific method and the West's understanding of what
science means to them.

The ELSI parts of projects usually do not have any other route than to go
through Indigenous scientists as often
Indigenous Academia is spread too thin.

Hi all,

Hank and I have had diametrically opposed schedules and so have just this evening managed to have a conversation to do a formal handoff of ELSI Committee Chairing duties, and for me to get a debrief of the February meeting, which I missed due to travel.

As such, and with apologies, I am cancelling the 3/13 (3/14) meeting and will reschedule it for Wednesday the 20th or Thursday the 28th. I will send another email soon with the details (including a draft agenda).

Please find attached the minutes from the October meeting. I’m including here one critical section from the minutes:

* I tried scheduling meetings month-to-month to enable all members of our committee to attend at least some percentage of the meetings, but this just led to a great deal of confusion – I’m sorry for this!
* Going forward, we will return to the 2nd Thursday of the month at 9am Eastern, and I will schedule individual meetings with committee members for whom this time is prohibitive, at your request.
* I will ask Nicolette to recirculate the calendar

I am attaching my thoughts on the current draft of the policy and in particular point 2, on top of Uljana’s so they are in one document.

The statement that EBP sequences have to be free of all encumbrances that was in the first paragraph is not compatible with the EBP Governance document that we have all previously agreed – see below. EBP recognises that there are national and IPLC rights and equitable interests, and there will be tension between these and unrestricted use. I hope everyone is alright!
I would like to justify my absence from the last meeting because I was returning from COP 28 on Climate Change in Dubai.
It was my first Climate COP and I can say that it is impressively much bigger and complex than the Biodiversity COP. There were 108.000 people.
It was a great experience. I even met David Cooper, the Acting Executive Secretary of the CBD, quickly. I believe that the tendency is for the two COPs to be very aligned.

Next meeting is scheduled for Thursday, January 11 though I just realized I am going to be in Chile that day (currently +5 hours from California) and I don’t know my schedule. I’ll have to figure that out and then see when/how to hold the meeting. (I’m also, as always, worried about John’s timing as our regular time conflicts with the DSI scientific working group, which you may be on, too.
